This Privacy Policy provides information about how Sunrider International collects, uses, shares and transfers information relating to individuals (“Personal Information”), and information about your rights and choices regarding our processing of your Personal Information. A reference to “Sunrider”, “we,” “us,” or “our” in this Privacy Policy is a reference to Sunrider International and any affiliate involved in the Personal Information processing activity. (collectively referred to in this Privacy Policy as the "Site"),  This Privacy Policy applies to online services provided by us or our affiliates that contain a link to this Privacy Policy, and to any form of communication between you and us (collectively referred to as the “Services”). Please read this Privacy Policy carefully. By explicitly accepting this Privacy Policy, interacting with the Site or otherwise providing your Personal Information and other information through our Services, you agree that we may collect, use, share and/or transfer that information in accordance with the terms and conditions of this Privacy Policy, subject to your rights and our obligations under applicable law. This means that you consent (including separate consent if so required by applicable law) to the collection of your data if you are based in a country where your consent is required for us to collect and process your Personal Information.  I. INFORMATION SUNRIDER COLLECTS  

Mandatory Personal Information Collected From You  When you submit an online application to become an Independent Business Owner ("IBO"), a Wellness Consultant (“WC”) (Philippines only) or an Authorized Business Owner ("ABO") (People's Republic of China only), Sunrider collects the following Personal Information from you: 

  • Name; 

  • E-mail address; 

  • Billing information, including your address, telephone number, and fax number; 

  • Sponsor information (the name and details of the IBO, WC or ABO who introduced you to Sunrider); 

  • Social Security Number or equivalent government identifier (where we are required by law to collect this e.g. to report to tax authorities on commission earnings); 

  • Date of Birth; 

  • Sex; 

  • Marital Status; 

  • All the above information for the spouse of the IBO, the WC. the ABO, the co-applicant, and the spouse of the co-applicant, if the applicant wishes to operate a Sunrider business with their spouse*;  

  • Credit card number to process your orders;  

  • Bank and bank account information in order to receive direct deposit for bonus checks or a bank draft for payment; and  

  • A personally chosen user name and password for utilization with your assigned ID number.   

*Where Spousal Personal Information and/or any third party Personal Information is provided by you to us, you hereby warrant and represent that you have obtained all necessary consents (including separate consent if so required by applicable law) under the applicable law to permit you to disclose and transfer the Spousal Personal Information and/or third party Personal Information to us, and permit us to use and process such Spousal Personal Information and/or third party Personal Information for all of the purposes set out in this Privacy Policy. 

In addition, we collect the following information relating to the activities of ABOs, IBOs and WCs: 

  • Orders for products they place as direct customers; 

  • Name and contact details of each ABO, IBO, WC, Retail Customer and/or Preferred Customer which an ABO, IBO or WC introduces (and which any of them introduce – i.e. the downline); 

  • Orders for products and the value of orders placed by individuals in an ABO, IBO or WC's downline; 

When you submit an online application to become a Retail Customer or Preferred Customer, Sunrider collects the following Personal Information from you: 

  • Name;   

  • E-mail address;  

  • Contact information, including your address, telephone number, and fax number;  

  • Bank and bank account information in order to use a bank draft for payment;  

  • Credit card number to process your orders (only our payment processor will process your full credit card number).  We may be provided with some parts of your financial information related to the transaction such as the last four digits of your payment card.; and  

  • A personally chosen user name and password for utilization with your assigned ID number.  

When you purchase products as a Retail Customer or Preferred Customer, Sunrider collects the following additional information: 

  • Order and delivery information (including delivery address if different from your registered address); 

  • Any communications with you in relation to the order. 

If you create and share content with us (for example, by uploading photos, videos, personal stories or other similar media to the Services or our social media accounts) we will process that content and associate it with your account. If you would like Sunrider to track and record your usage on its websites, you must OPT-IN to it. This function is automatically disabled, and will only be turned on if you request it. The purpose of this function is strictly customer service oriented and used in order to help you navigate our websites. Any information related to this service will be deleted after 30 calendar days. If you opt-in, Sunrider collects the following Personal Information from you: 

  • All keystrokes you make on our websites;  

  • Screen recording while using our websites;  

  • Your web browser name, version, and build platform for the browser used to access our websites;  

  • Your device hardware IP address, hardware name, and operating system version for the device used to access our websites.   

If you have opted into the web tracking services, you can turn these tracking services on and off whenever you like by going to your Account page and changing your preferences. We may combine the Personal Information that we have collected about you with other information about you obtained from other sources (both online and offline), such as from third parties and public sources. If you provide us, our service providers, or our affiliates with any Personal Information relating to other individuals, you represent that you have the authority to do so, and where required, have obtained the necessary consent (including separate consent if so required by applicable law), and acknowledge that such Personal Information may be used in accordance with this Privacy Policy.  

Website Use & Navigation Information  

Sunrider collects the following information when you visit our Site: 

  • Cookies 

Upon entering the Site, the Site places a Session Cookie for your web browser into your computer's Random Access Memory ("RAM"). In order to place an order or utilize the business management functions on the Site, you must log on with your ID number and password. Once you log on, the Session Cookie allows the Site to remember your ID number and rank. No other Personal Information is stored in the Session Cookie. The Session Cookie is deleted from your computer's RAM when you exit your web browser. The Site also places a Persistent Cookie for the web browser on your computer. The Persistent Cookie enables the Site to remember the country, language, and date of your visit. If you return to the Site, you will be presented with the country and language that you chose the last time you entered the Site. No personally identifiable information is stored in the Persistent Cookie. From time to time, Sunrider may use third party services to improve the performance of the Site, and these services may place additional non-personally identifiable information in your Persistent Cookie. Sunrider does not track or maintain records of Session or Persistent Cookies. If you set your browser to disable essential cookies, you will be unable to access and utilize the Site. If you reject non-essential functional cookies you are likely to experience a reduction in the functionality of the Site.

Collection of Visitor Information  

If you choose, you may browse the Site without entering your ID number during your visit. Sunrider stores the Internet Protocol address, the time and date of entry, and the specific pages viewed by each visitor to the Site. Sunrider also stores the ID number if you log on with your ID number. This information is maintained for security purposes only, and will not be disclosed to third parties.  Subject to their availability in your country, we use third-party web analytics software, such as Google Analytics and Google Tag Manager, in connection with our Sites. Web Analytics software helps us understand how visitors interact with the Site, how we can further improve the user experience, and how we can attract new customers. Information collected through these means may include, without limitation, web browsers used to access our Sites, the length of visits to certain Site pages, and page response times.  Sunrider also contracts with third party advertising networks including Facebook/ Meta, Google (subject to their availability in your country) that collect IP addresses and other information from pixel tags or web beacons on our Site, in our emails, and on third party websites. These networks use cookies and other device and usage data in order to recognize individuals who have previously visited a particular website. This information is used to measure advertising effectiveness and provide advertisements about our products or services tailored to your interests.  

We provide access to social media plug-ins from the following social media companies:  Youtube, Facebook, and X (subject to their availability in your country). Plug-ins are displayed on our Site to enable you to easily share information with others. We may also use the information collected from the plug-ins, such as your demographic data and marketing or product preferences, to learn about your interests and better serve you. These plug-ins may allow social media companies to receive Personal Information about you and your visit to our Site through the placement of cookies on your computer. This enables companies to recognize you on websites belonging to them, their affiliates, and their partners, and to use information collected from your visit to our Site to supplement information about your prior activity on those websites.  The plug-ins collect such information about users regardless of whether they specifically interact with the plug-in. 

Sunrider does not control what information is collected by the social media plug-ins, or whether the social media companies share this information with other users. We encourage you to refer to the privacy statements on the social media company websites for more information on social plug-ins.  

Failure to provide Personal Information that is necessary for certain Services or features may limit your ability to use those Services or access those features.

 II. HOW SUNRIDER USES THE INFORMATION WE COLLECT  

This section describes the business purposes for which Sunrider uses the Personal Information we collect. Please note that there may be other uses, which we would describe to you when we collect the information.  When contracting with you

  • To confirm, process, ship, and invoice your orders;  

  • To calculate earnings, bonuses, and qualifications;  

  • When you use our Site under the applicable Terms of Use; and   

  • For other contractual purposes i.e. to meet the terms of our agreements with you. 

For our legitimate business interests, which are to: 

  • Respond to your inquiries and requests, send communications, and other customer services;   

  • Provide training and information on new products and services;  

  • Provide and improve our products and services;  

  • Ensure compliance with the Site  Terms of Use;   

  • Maintain the safety, security, and integrity of our Site, products and services, databases and other technology assets, and business;  

  • Verify your identity in connection with a communication, transaction or account between you or us or in connection with your exercise of your privacy rights; and   

  • Provide and improve our Site and make the Site more useful and valuable for you and your Sunrider organization.  

Consent  We will use or disclose your Personal Information for other purposes when we have obtained your consent to do so (including separate consent if so required by applicable law), including when you opt in to receiving certain communications where required under applicable law. If we are using your Personal Information based on this ground, you may withdraw your consent at any time by contacting us using the contact information below.  Compliance with legal obligations Sunrider will use or disclose your PersonaI Information when necessary to:  

  • Comply with a court order, subpoena, or warrant;  

  • Comply with the request of a government agency or regulatory body 

  • Collect monies owed to Sunrider; 

  • Investigate activities that Sunrider believes in good faith are unlawful; 

  • Enforce or apply our Terms of Use; or 

  • Protect the rights, property, and safety of third parties and Sunrider.  

III. HOW SUNRIDER SHARES INFORMATION WE COLLECT  

Except as otherwise stated in this Privacy Policy, we do not sell, trade, or rent your Personal Information.  Sunrider does not share your information with any third parties for their direct marketing purposes.  

We may share or disclose your Personal Information (including all categories of Personal Information collected as described in Section I above) for a business purpose with third parties, including affiliates, agents, vendors, or service providers who assist us in the process of providing products or services to you, or otherwise perform functions on our behalf. These third parties use your Personal Information only at our direction.  

Your Personal Information (including your birthday (month and day only) may be shared with our members in your "uplines" – i.e. the IBO, ABO or WC who introduced you to Sunrider and the IBOs, ABOs and WCs who introduced them (all the way 'up the chain'). In addition, for the sole purpose of allowing support and the management of your "downline" (i.e. the IBO, ABO or WC who you have  introduced to Sunrider and the IBOs, ABOs  and WCs who they have introduced (all the way 'down the chain') , Sunrider provides, in the strictest confidence, the Personal Volume (and volume in monetary value), Downline Volume (and volume in monetary value), bonus recap, ID Number, sponsor's name, name, birthday (month and day only) and contact information of your downline in Personal Volume  and Downline Volume and financial Management Reports ("Reports"). Personal Volume and Downline Volume are defined in the Compensation Plan hosted on the Site. The Reports, including all data contained therein, constitute confidential, proprietary trade secrets of Sunrider. IBOs, ABOs, WCs and Retail/Preferred Customers may not collect, distribute, or gather personally identifiable or confidential information about other IBOs, ABOs, WCs or Retail/Preferred Customers, except: (1) in connection with their downlines and solely for the purpose of promoting their Sunrider Independent Business; and (2) to manage and train their downlines. If the IBO, ABO or WC  is located outside your home country, their home country may not offer the same or a similar level of privacy protection as in your country. However, Sunrider will take reasonable measures to ensure that the information in the Reports is kept secure and held in confidence. 

We reserve the right to disclose your Personal Information if permitted or required by law, or in response to a law enforcement or other legal request and/or to comply with a judicial proceeding, court order, or legal process. We also may disclose your Personal Information if we believe such disclosure is necessary to protect or defend our rights, assets or interests or the interests of our users or as necessary to protect the public from harm and disclosure would not override your interests. If we sell or transfer a business unit or asset to another company or enter into a strategic business transaction, we may share your Personal Information with parties to the transaction to disclose our assets, respond to due diligence requests, or for other purposes to facilitate the business transaction. We may share aggregated data with third parties collectively in an anonymous way, which does not reveal Personal Information. In addition, we may share your Personal Information with a third party at your request, or if you consent to the disclosure. 

 IV. YOUR RIGHTS AND CHOICES  

Opting Out  

If you do not wish to receive marketing information from us, you may opt out by: (1) declining marketing information when registering or at other information gathering points on the Sites, or (2) informing us that you no longer wish to receive marketing communications by emailing us at privacy@sunrider.com. We will comply with these requests except with respect to communications required by law or contract, or that do not require your consent under applicable laws.  

Accessing, Correcting or Deleting Your Personal Information  

You have the right to request access to, obtain a copy of, correct, request cessation of processing or use, or deletion of your Personal Information, where provided for under and subject to applicable data protection laws. To exercise these rights, please use the Change Profile page on the Site, or contact Sunrider by email: privacy@sunrider.com.  Please include your name, address, ID Number, and/or email address when you contact Sunrider. You may update your information on the Change Profile page or change your password on the Site.  If you request deletion of your Personal Information, Sunrider may keep some of your information on file for business and legal reasons as permitted under applicable law.  

V. COUNTRY SPECIFIC RIGHTS, CHOICES, & INFORMATION  

Rights for Individuals based in certain US States 

  • Depending on where you reside, you may also have additional legal rights with respect to your Personal Information. Consistent with applicable laws, this Statement provides information about such rights and how to exercise them for residents of California and Virginia (“you” or “your”) who are interacting with Sunrider International (“Sunrider,” “we” or “us”). This Statement applies to residents of Colorado, Connecticut and Utah to the extent the disclosures provided herein are required, and the rights described herein are in effect, under applicable state data privacy laws.   

  • For purposes of this Statement, “Personal Information” has the meaning given in the California Consumer Privacy Act of 2018 as amended, the Virginia Consumer Data Privacy Act, and personal information privacy laws similar in scope and content in effect in Colorado, Connecticut, Utah and other US states (“US Data Privacy Laws”), but does not include information exempted from the scope of such US Data Privacy Laws. This Privacy Statement does not apply to Personal Information relating to employees, contractors and job candidates that is collected and processed in the context of an employment relationship.  

Rights for Individuals based in Nevada 

  • Nevada law gives Nevada consumers the right to request that a company not sell their personal information for monetary consideration to certain third parties, even if their personal information is not currently being sold.  Rights for Individuals based in the European Economic Area (EEA), Switzerland, or United Kingdom (UK) 

If you are in the European Economic Area, United Kingdom, or Switzerland, your personal information may be protected by the European Union General Data Protection Regulation, United Kingdom Data Protection Act, or the Swiss Federal Act on Data Protection (collectively, “European Privacy Laws”). For individuals whose Personal Information is protected by the European Privacy Laws, please know that Sunrider International is the data controller responsible for the collection, use, and disclosure of your Personal Information under this Privacy Statement. If your Personal Information is protected by the European Privacy Laws, you may have the following rights in relation to your Personal Information:  

  • The right to access: You have the right to request from us a copy of the Personal Information we hold about you.  

  • The right to rectification: You have the right to request that we correct any Personal Information about you that is inaccurate, and to request that we complete the Personal Information we hold about you where you believe it is incomplete.  

  • The right to erasure: You have the right to request that we erase your Personal Information, under certain conditions. In the event of an erasure request, we may retain a copy of your Personal Information for our recordkeeping purposes and to avoid entering your Personal Information in our systems after your request.  

  • The right to restrict processing: You have the right to request that we restrict the processing of your Personal Information, under certain conditions.  

  • The right to object to processing: You have the right to object to our processing of your Personal Information, under certain conditions, and you have an unconditional right to object to the processing of your Personal Information for direct marketing purposes.  

  • The right to data portability: You have the right to request that we transfer the Personal Information we have collected about you to another organization, or directly to you, under certain conditions. You can also request a copy of your Personal Information in a structured, common, and machine-readable format. 

  • The right to withdraw consent: Where we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time. Your withdrawal of consent does not impact the lawfulness of our processing up to the point of consent withdrawal.  

  • The right to restrict processing: You have the right to request that we restrict the processing of your Personal Information, under certain conditions.

Please note that there are exceptions to the various rights listed above. As an example, in certain circumstances we may have a legal obligation to retain some of your Personal Information. We try to respond to all legitimate requests within one month or quicker if legally required to do so. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.  

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information or to exercise any of your other rights. This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. 

 If you would like to submit a complaint regarding our practices in relation to your Personal Information, please email privacy@sunrider.com. We will reply to your complaint as soon as we can. If your Personal Information is protected by the European Privacy Laws and you feel that your complaint has not been adequately resolved, you have the right to contact your local data protection supervisory authority. Rights for Individuals based in Hong Kong  

This section applies if Sunrider International (Hong Kong) Limited controls all or any part of the personal information data cycle in, or from, Hong Kong. This section has been prepared in compliance with the Personal Data (Privacy) Ordinance (Chapter 486, Laws of Hong Kong). Your Rights You are entitled to the following rights in respect of Personal Information that we hold: 

  • Right To Access: You have the right to request a copy of your personal information held by us, unless we are exempted from complying with a data access request. 

  • Right To Correction: You have the right to request for us to make necessary corrections in respect of any personal information that you consider inaccurate after we have fulfilled a data access request from you. We may refuse a data correction request if we believe the personal information is accurate, an expression of opinion or the proposed correction is inaccurate. 

If you wish to access or correct your personal information, please contact us by emailing privacy@sunrider.com.  We reserve the right to charge a reasonable fee to process any personal information access or correction request. Direct Marketing  We may use your personal information for direct marketing purposes. However, we will not use your personal information for such purposes unless we have received your consent.  The types of personal information we may use for direct marketing purposes are: 

  • Name; 

  • Age; 

  • Gender; 

  • Mobile phone number; 

  • Email address; and  

  • Residential/correspondence address. 

The direct marketing activities we intend to conduct using your personal information are: 

  • Direct marketing and promotional information about our products and Services similar to those you previously purchased or used; 

  • News about our products and Services; 

  • Special offers; 

  • Festive greetings; and 

  • Other materials relating to our Services and loyalty program;  

If you have not expressly indicated your consent, then we will not use the types of personal information for the direct marketing activities described in this section. You may in future withdraw your consent to the use and provision of your personal information for direct marketing. Rights for Individuals based in Australia 

The Privacy Act 1988 (Cth) (Australian Privacy Act) gives Australian consumers the right to complain about a breach or perceived breach of their rights.  If you believe that a breach of your rights under the Australian Privacy Act has occurred, you may contact Sunrider’s DPO (privacy@sunrider.com). Sunrider may be able to resolve the breach by correcting or destroying your information. Information for Individuals based in the State of Israel 

The processing of your personal information by Sunrider is based on your consent, which may be given explicitly or implicitly through your interaction with this privacy policy. You are not legally obligated to provide any personal information, and any disclosure is entirely voluntary. However, if you choose not to provide certain requested information, we may be unable to engage with you or provide specific services. Rights for Individuals based in India  Notwithstanding anything to the contrary contained in the Privacy Policy, the following additional provisions will apply to Personal Information related to persons/individuals in India: 

  • Legal Basis for Processing - We collect and process your personal data only pursuant to your express consent, or where permissible for the legitimate uses permitted under applicable law, for the purposes specified in this Privacy Policy. 

  • Your Data Privacy Rights - You can exercise the following rights in addition to the rights set out in the other sections of this Privacy Policy with respect to your personal data:  

    • Right to nominate: You have the right to nominate one or more individuals to exercise your rights under this Privacy Policy in case of your death or incapacity (i.e., inability to exercise statutory rights granted to a data principal due to unsoundness of mind or infirmity of the body).

Before processing your sensitive Personal Information (which refers to PI that, if leaked or illegally used, could easily result in infringement of a natural person’s dignity or endangering of personal / proprietary security, which include (but not be limited to) biometric information, religious belief, special identity, medical and health information, financial account, tracking and whereabouts, information of minors below the age of 14), we will always disclose concerned types of sensitive Personal Information as well as corresponding processing purposes to you, and will obtain your separate consent upfront. As far as we share, transfer your Personal Information to any third party regardless of whether such third party is within or outside China, we will obtain your separate consent in advance. VI. SECURITY  

Security of Information

We use commercially reasonable administrative, physical and technical measures intended to safeguard your Personal Information and help protect it from unauthorized access or loss. Unfortunately, no data transmission over the Internet is 100% secure, and while Sunrider makes every effort to protect your Personal Information, Sunrider cannot guarantee its complete security. Because security is as important to Sunrider as it is to you, Sunrider will continue to search for and implement security measures in order to protect the security of your Personal Information. In the event of a data breach requiring notification under applicable law, we will notify affected individuals and/or relevant authorities.  

ID Number, User Name, and Password

Your ID number, user name, and password are specific to you and must be safeguarded by you. You accept sole responsibility for all use of the Site conducted with your ID number, user name, and password. Sunrider strongly advises that you change your password frequently.   

Stolen or Lost Information

You must promptly notify Sunrider via email at info@sunrider.com if you suspect that your credit card number, ID number, user name, and/or password has been lost, stolen, or used without your permission. After receiving your notification, Sunrider will remove that credit card number, ID number, user name, and/or password from your account and update its records accordingly. 

VII. INTERNATIONAL TRANSFERS  

Any Personal Information you provide to Sunrider, and that Sunrider shares with affiliates, agents, vendors and service providers, may be stored and processed, transferred between and accessed from the United States and other countries, which may not guarantee the same level of protection of Personal Information as the country in which you reside. However, we will handle Personal Information collected through the Site and other means in accordance with this Privacy Policy, and in compliance with applicable law. Please see section III above for a table of data recipients, including international transferees and details of the transfer, purpose legal basis and transfer period. We will fulfil any applicable obligations associated with such international transfers, such as export clearances (e.g. standard contract filing and/or security assessment), if so required by applicable law. 

VIII. LINKS TO OTHER WEBSITES  

In order to provide information to users, we may provide links to or compatibility with other websites or applications. We are not responsible for the privacy practices employed by those websites or the information or content they contain. To the extent you access a third-party website, the privacy policy of that other website will apply to your access of that site. We encourage our users to read the privacy statements of other websites before proceeding to use them.  

IX. DATA RETENTION  

We may retain your Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained and as outlined in this Privacy Policy and only in accordance with applicable law. We will keep your Personal Information for periods of time needed to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements, and otherwise as permitted by law. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide Services to you for the purposes as provided under this Privacy Policy; (ii) whether there is a legal obligation to which we are subject;  (iii) whether retention is advisable in light of our legal position (such as in regard to the enforcement of applicable Terms of Use, applicable statutes of limitations, litigation or regulatory investigations) or (iv) if you withdraw your consent provided under this Privacy Policy, whichever is earlier, unless the retention of such Personal Information is required under any other applicable law for the time being in force. We will destroy your Personal Information when retention becomes unnecessary, such as the expiration of the retention period or the achievement of the processing purpose.  

Destruction process and method  

Once your Personal Information is no longer required to be retained, it is moved to a separate database and is deleted by using technical means which makes it impossible to restore the data. We destroy your Personal Information through de-identification so that the individuals cannot be identified. 

X. CHILDREN’S PRIVACY PROTECTION  

The Site is a general audience site that is not specifically designed or targeted at children. Sunrider does not knowingly collect, use, or disclose personally identifiable information about visitors under the age of majority. As such, Sunrider does not sell or share Personal Information of consumers under 18 years of age (19 in the Republic of Korea). By accessing our Sites or initiating any communication with us, you represent that you have attained the age of majority in your location.  

XI. CHANGES TO PRIVACY POLICY  

Sunrider reserves the right to change this Policy at any time. Sunrider will post any changes to this Policy with their effective dates. If Sunrider makes material changes to this Policy, Sunrider may also communicate them by email or conventional mail. Sunrider will make reasonable efforts to ensure your Personal Information is up to date. You acknowledge and agree that it is your responsibility to update Sunrider with your current contact information, review this Site and this Policy periodically, and to be aware of any modifications unless otherwise required under applicable law. You can update your information on the Change Profile page on the Site. Your continued use of the Site after any modifications will constitute your acknowledgment of the modified Policy and your agreement to be bound by it.

XII. INTERPRETATION
